Permitting: Exemption for Small Sources

 

What is a Small Source Exemption?

Businesses with low levels of air emissions may be exempt from R307-401-5 through 8, Permit Notice of Intent thru Approval Order. The small source, R307-401-9, exemption allows smaller sources of air pollution greater flexibility to make changes in their emissions as long as they can show they remain eligible for the exemption.

What Businesses are Eligible for the Small Source Exemption?

A business is eligible for this exemption if it:

  1. Emits less than 5 tons per year of any of the following pollutants; particulate matter (PM10), sulfur dioxide (SO2), carbon monoxide (CO), nitrogen oxides (NOx), and volatile organic compounds (VOC).
  2. Emits less than 500 pounds per year of any hazardous air pollutant (HAP), and less than 2000 pounds per year for any combination of HAPs.
  3. Emits less than 500 pounds per year of any air contaminant not listed in (1) or (2) above and less than 2000 pounds per year of any combination of air contaminants not listed in (1) or (2) above.

Do I Register for the Small Source Exemption?

Eligible businesses are not required to fill out a Registration Notice. You can download the registration form and instructions from our forms page. Businesses are encouraged to call the Division at 801-536-4000 for assistance in determining whether they are eligible for the exemption.

How Do I Do an Emission Calculation?

If My Emissions Exceed the Small Source Exemption Category, What Do I Do?

If on February 2007 your emissions exceed the small source category, 180 days after the end of the calendar year (December 2007) you need to submit a notice of intent (permit application) R307-401-5.
